1. WHAT DOES THIS PRIVACY POLICY COVER?

This Privacy Policy explains how pangaea collects, uses, discloses and otherwise processes information in connection with the pangaea platform available via web browser and mobile application (the “Platform”) and other pangaea Products (“pangaea Products”) (collectively, the “Services”). pangaea is a product of NDXCO PTE. LTD.

When we use the term “Personal Information” in this Privacy Policy, we are referring to any information that identifies or could be used to identify a natural person. References to “Student Personal Information” means Personal Information of students who have registered for the Platform in connection with a School account. General references to “Personal Information” or “information” apply to all users.

2. HOW IS STUDENT PERSONAL INFORMATION COLLECTED AND TREATED?

The pangaea Service is made available to select educators, schools, school districts and other educational institutions (collectively, “School”) to use with students for an educational purpose.

Through the course of providing our Services to a School, we collect Personal Information from and about students (“Student Personal Information”) that is provided by the School, by a parent or guardian, by the student or by other users. Student Personal Information may include personal information of a “child” as defined by applicable privacy laws. For example, in the U.S., a child means a person under the age of 13, or in Thailand, a child means a person under the age of 10 as defined by applicable civil law, though this age may vary by jurisdiction.

Protecting the privacy of children and students is very important to us. We collect Student Personal Information from a child with appropriate consent and authorization required by law. We collect Student Personal Information through the Platform from students only when we are authorized by a teacher, school administrator or other educational user who has provided each such student with a class code. In most cases, a school district or administrator authorized to deploy the pangaea Platform and pangaea Products in school will grant us permission to access and collect the Personal Information of the student as necessary to provide the Services. In some jurisdictions, we may also seek parental consent for the child to use the Service, if required by law. If we learn we have collected Student Personal Information from a child or student without appropriate authorization and consent as outlined herein, we will delete that information as quickly as possible. If you believe that a child may have provided us Personal Information in violation of this paragraph, please contact us at legal@pangaeaedu.com.

We collect and use Student Personal Information solely as needed to provide the Service on the School’s behalf for educational purposes, to support and improve the Service and for other purposes described in this policy. We limit the collection of Student Personal Information to no more than is reasonably necessary to provide the Service.

If you are a student: your parent or guardian, teacher, or school administrator may view all information within or associated with your Platform account, including, without limitation, messages between you and your teacher and grades you received on assignments.

3. WHAT INFORMATION DOES pangaea COLLECT?

A. Information You Provide to Us

To create an account on our Platform, we collect first name, last name, user name and email address. We may collect additional information if, at your option, you complete a user profile or engage with the features of the Platform and pangaea Service, including but not limited to, date of birth, phone number, profile picture, school affiliation, school location, information about a child’s parent or guardian, and course or classes enrolled in, as well as educational content and information such as grades, assignments, messages and communications, and student-generated content. We may collect some of this information from other users, for example, if a teacher provides the Student Personal Information to generate accounts for students in the teacher’s class. You must have an account to use the pangaea Service. Accordingly, if you do not want to provide the personal information required to create an account, you will not be able to use the pangaea service.

If you are registered in the Platform with a student account and your pangaea account is part of a Limited Access Group, teachers or administrators from your school or school district can view all activity, content and Personal Information in your student account. For the purposes of this Privacy Policy, the term “Limited Access Group” means any grouping of user accounts corresponding to a teacher or administrator, within which users may communicate and share content with one another. Also, with regards to student accounts, if your school permits the option, your parent or guardian may be able to view all activity and content associated with your student account.

You can log in to our site using certain third-party sign-in platforms such as Office 365 or Google. These third-party platforms authenticate your identity and provide you with the option to share certain Personal Information with us, including your name and email address, to pre-populate our account sign-up form. If you choose to enable a third party to share your third-party account credentials with pangaea, we may obtain additional information about you via that mechanism. You may adjust the information the authentication service shares with us and/or revoke access at any time by adjusting your settings with the authentication service.

If you elect to connect your pangaea account with Google or Microsoft, pangaea may also access your Google Drive or MS OneDrive (as applicable) so that you may browse your Google Drive or MS OneDrive files to select one or files that you may wish to include as an attachment when communicating with another pangaea user or for sharing files within your class or Limited Access Group. If you use our Library or Agenda features to edit your Google Drive or MS OneDrive files, pangaea will also access your Google Drive or MS OneDrive (as applicable), with your permission.

B. Information Collected Automatically

Like most websites and online services, pangaea automatically collects certain types of usage and device information when you visit our websites, read our e-mails, use our Service or otherwise engage with us. This information is typically collected through a variety of tracking technologies, including cookies, web beacons or pixels, log files, and similar technology, and we may use third party providers to collect this information on our behalf. Using these tools, we and our providers collect information about how you access and use the Service (e.g., referring / exit pages and URLs, how frequently you access the Service, the pages you view, the links you click, and other actions you take on the Service); information about your browser and information about the device(s) you use to access the Service (e.g., Internet Protocol (IP address), browser type, browser language, Internet service provider, device type, model and manufacturer, a unique ID that allows us to uniquely identify your browser, device or account, operating system brand and model, and whether you access the Service from multiple devices). We may also collect information about your geographical location data at the city level. At times, we may combine this information with Personal Information or Student Personal Information. We may collect analytics data, or use third-party analytics tools, to help us measure traffic and usage trends for the Service and to understand more about the demographics and behaviors of our users.

We use or may use this data to analyze and improve the Service, to secure the Service, to save you time, to provide better technical support, to personalize or customize your experience and to track website usage. For example, we may use this data to keep track of whether you are signed in or have previously signed in so that we can display all the features that are available to you; remember your settings; customize the function and appearance of the pages you visit based on information relating to your account; for example, to default you to a particular grade level, or to remember customized settings for a report; track website usage for various purposes including website optimization, website improvement and sales.

Most browsers are initially set up to accept cookies, but you can reset your browser to refuse all cookies or to indicate when a cookie is being sent. However, some features and services (particularly those that require you to sign in) may not function properly if your cookies are disabled. You may also set your e-mail options to prevent the automatic downloading of images that may contain technologies that would allow us to know whether you have accessed our e-mail and performed certain functions with it.

4. WHAT DOES pangaea USE MY INFORMATION FOR?

A. To provide and maintain the Service.

When you use the Platform, you may set up your personal profile, form relationships, send messages, perform searches and queries, and transmit information through various channels, depending on the User Category (teacher, administrator, student, parent) you are registered within the Platform. We use Personal Information and Student Personal Information to provide the requested services, personalize the Platform for users, facilitate communications between users (including between members of Limited Access Groups), provide customer support and otherwise provide, operate, deliver and support the features and functionality of the Platform and Service.

B. To improve, personalize and develop the pangaea Platform and Service.

We use Personal Information and Student Personal Information to tailor the content and information that we may send or display to users, to offer personalized content and materials, and to otherwise customize your experience while using the Service, including on various devices you may use to access the Service. We collect statistics to better understand how users access and use our Service, monitor the effectiveness of our Service, detect usage patterns, and to diagnose or fix technology problems. We also use information to demonstrate the effectiveness of the Service and perform research, and to develop, support, and improve our Service and other educational products and services. Certain usage-related information may be displayed to other users, depending on your User Category. For example, a Badge may be displayed in your profile indicating that you have achieved a goal within the Platform.

C. To communicate with you.

Email communications. We use Personal Information to send you email communications, including transactional notifications, news and updates. We may send periodic promotional or marketing materials, including newsletters, new releases, surveys, or contests or events, to adult users only. Web beacons may also be used in some of our emails to let us know which emails have been opened by recipients, which allows us to gauge the effectiveness of our customer communications. If you no longer wish to receive emails from pangaea, please click the unsubscribe link that is included in the footer of our emails, update your email preferences, or contact us at support@pangaeaedu.com. Please note that, even if you unsubscribe, we will continue sending you emails for critical or essential updates or notifications.

Mobile push notifications. If you use the Mobile App, we will send push notifications to your mobile device in order to make you aware of certain activities that may occur within your pangaea account, such as when someone has entered a new post, when you have new notifications, or when grades have been posted. You may opt-out of receiving these types of communications by turning them off at the device level or emailing us at support@pangaeaedu.com.

Notifications to students. We use Student Personal Information to send notifications via the Platform from their teacher, school, district, fellow Limited Access Group members, and pangaea (“Notifications”) through the Platform, email and/or mobile push notification. We do not send promotional emails to Student users of the Platform.

5. HOW WILL pangaea SHARE MY PERSONAL INFORMATION OR STUDENT PERSONAL INFORMATION?

We do not sell any Personal Information or Student Personal Information to third parties for commercial marketing or advertising purposes.

We may share or disclose Personal Information and Student Personal Information in the instances described below.

A. Other Users (User Profiles and User Content)

If your User Category allows it, at your option, you may choose to populate your user profile on the Platform with your name, photograph, school affiliation and other information. This user profile information will be displayed to other users to facilitate user interaction within the Platform or with pangaea Products. If you are a student, the only users who may view your profile are those who belong to your Limited Access Group(s). However, please keep in mind that information that you voluntarily disclose online to your Limited Access Groups, or to your connections (Teachers only) will become available to other users and can be collected and used by others, in accordance with the privacy settings you select in your account preferences or in accordance with the User Category to which you belong. Any images, captions or other content that you submit to the Platform or to pangaea Products in a manner that any other user can view may be redistributed through the Internet and other media channels. For example, if you are a student, the content you share with your Limited Access Group(s) will be displayed to other members of that Limited Access Group; we cannot, however, control what other members of your Limited Access Group will do with such content after you have disclosed it. Your name may be displayed to other users when you upload images or videos or send messages through the Platform and other users can contact you through messages and comments.

Additionally, if you are a student, your parent or guardian, teachers or school administrators may view all information within or associated with your Platform account, including, without limitation, your profile information, messages between you and your teacher or members of your Limited Access Group, content you upload and grades you receive on assignments.

B. Third-Party Service Providers

We employ other companies and people to perform tasks on our behalf and we may need to share your information with them to operate and deliver our Service to you. Examples include sending emails, analyzing data, or providing support or other services needed to support our delivery of the Service. We will only share your Personal Information or Student Personal Information with a third party when we have determined such sharing is necessary or appropriate to enable us to operate and deliver the Platform or the pangaea Products, and where each such third party has agreed to (i) use any Personal Information shared only for the purposes of supporting us and for no other purposes, (ii) to maintain any Personal Information shared as confidential information, and (iii) to implement appropriate physical and technical security measures and safeguards to protect any Personal Information shared.

C. Affiliate Companies

We may share and disclose Personal Information and Student Personal Information with our affiliated companies within our corporate family of companies as needed to facilitate and provide our Service. These entities will use information in the same manner described in this Privacy Policy.

D. Business Transfers

If pangaea becomes involved in a merger, acquisition, bankruptcy, change of control, or any form of sale of some or all of its assets, your Personal Information or Student Personal Information may be transferred or disclosed in connection with the business transaction. In such an event, we will make efforts to provide notice before Personal Information is transferred and becomes subject to a different privacy policy. We will not transfer Student Personal Information in the event of a merger, sale or similar business transaction unless the recipient has committed to uphold the same privacy commitments for previously collected Student Personal Information under this Privacy Policy or we will provide our school customers notice and an opportunity to opt out of the transfer by deleting school accounts before any such business transfers occur.

E. Protection of pangaea and Others

We may disclose Personal Information or Student Personal Information when such release is necessary or appropriate to comply with applicable laws; when we are compelled to do so by a court order or other legal process; to enforce or apply our Terms of Service and other agreements; or to protect the rights, property, or safety of the pangaea Platform, pangaea Products, our employees, our affiliates, our users, or others. To the extent possible, we will give you notice if we release information for these reasons.

6. IS INFORMATION ABOUT ME SECURE?

Your pangaea account Personal Information or Student Personal Information is protected by a password for your privacy and security, as well as by other technical, administrative, and physical security measures and mechanisms. We have implemented a variety of physical, administrative and technological safeguards designed to preserve the integrity and security of the personal information we collect and to protect against unauthorized access to data.

You may help protect against unauthorized access to your account and Personal Information or Student Personal Information by selecting and protecting your password appropriately and limiting access to your computer and browser by signing off after you have finished accessing your account.

7. THIRD PARTY LINKS

While using the Service, you may elect to share Personal Information or content with one or more third-parties. Specifically, the Platform may include the ability for you to automatically transmit information you input on the Platform to your profile or account on a third-party website, or to automatically transmit information you input on a third-party website to your Platform profile. We have designed the Platform to enable you to recognize when a third-party is associated with a transaction or service that you may, at your option, elect to access or link to from within the Platform. Please note that we have no control over the policies and practices of these third-party websites or companies. Accordingly, please carefully review the Privacy Policy, Terms of Service, Terms of Use or other terms and conditions applicable to any third-party website or service before disclosing Personal Information or content to any such third-party website or service, where applicable.

8. WHAT RIGHTS DO I HAVE REGARDING ACCESS, DELETION AND RETENTION OF MY PERSONAL INFORMATION?

This section outlines the choices you have regarding your Personal Information.

In addition to the information in this section, you may also have rights if you are the resident of certain jurisdictions, as set forth below.

A. Access to Personal Information:

pangaea supports an individual’s right to access their Personal Information. Most of your Personal Information is readily visible to you through your account dashboard. To access any Personal Information that is not readily available through the Platform dashboard, you may submit an access request by emailing us at support@pangaeaedu.com.

B. Deletion of Personal Information or Your Account

To request removal of your Personal Information from our public forums, contact us at support@pangaeaedu.com. You may also be able to request the deletion of your Personal Information through your school administrator. Upon your request or the request of an authorized school administrator, we will delete your Personal Information from the Service. Please note that if you post information to your account that is subsequently copied, posted or shared by others outside of the Service, we will not be able to remove your Personal Information from such other products, services or websites.

If you are a Platform user who wants your Personal Information removed or deleted from our database, you can contact us at support@pangaeaedu.com in which case we will work with your school administration to confirm whether such removal is possible. Please note that such information may remain in our records after revision of such information or deletion of your account, in cached and archived pages. Some information may remain viewable elsewhere to the extent that it was copied or stored by other users.

Please note: We may not be able to immediately or completely delete all Personal Information in all instances, such as information retained in technical support records, customer service records, backups, and other similar business records. We will not be required to delete any information which has been de-identified or disassociated with personal identifiers such that the remaining information cannot reasonably be used to identify a particular individual.

C. Right to Object

You have the right to object to pangaea’s collection, use or processing of your Personal Information and to request the deletion of your pangaea account. If you are a Platform user who wants your Personal Information removed or deleted from our database, you can contact us at support@pangaeaedu.com in which case we will work with your school administration to confirm whether such removal is possible. Please note that such information may remain in our records after revision of such information or deletion of your account, in cached and archived pages. Some information may remain viewable elsewhere to the extent that it was copied or stored by other users.

D. Right to Rectification

You represent and warrant to pangaea that all Personal Information provided to us is true and accurate to your best knowledge. pangaea will endeavor to retain your Personal Information in an accurate and up-to-date manner. By accessing your pangaea account, you have access to the Personal Information processed by pangaea and the ability to update or correct any of your Personal Information that is not accurate. If you require assistance with the updating or correction of your Personal Information, or if you wish to submit a request to correct your Personal Information, please contact us at support@pangaeaedu.com.

E. Withdraw Your Consent

If you have given your consent to pangaea, you may withdraw the consent at any time. This will not affect the collection, use, and disclosure of Personal Information you have legally and previously consented to. However, if you exercise your right to withdraw your consent, your pangaea account will be deleted.

F. Retention of Personal Information

We will retain your Personal Information for as long as necessary for the purposes of operating and delivering you the Service. We may retain and process or use your information as we deem it necessary to comply with our legal obligations, resolve disputes, and to enforce our agreements. To protect your privacy, if your account is inactive for a lengthy period of time, we reserve the right to delete your account and any contents contained in your account.

9. WHAT CHOICES DO I HAVE REGARDING ACCESS, DELETION AND RETENTION OF STUDENT PERSONAL INFORMATION?

All Student Personal Information we collect through the Service is under the direct control of the School customer with regard to its use and maintenance. Depending on the laws in your jurisdiction, a parent or guardian may have the right to access or request deletion of Personal Information of their child. All such requests should be submitted to the child’s School, and not to pangaea. pangaea works with its School customers to support a parent’s right to access or delete the Personal Information of a child.

A. Access to a Child’s Personal Information.

Student Personal Information may be accessed and viewed by authorized teachers and account administrators associated with the child’s school account. This information is also accessible by a parent if and to the extent the school has configured the Service to permit parent account access to the child’s account. To access any personal information that is not readily available through the Platform dashboard, please contact us at support@pangaeaedu.com,

B. Deletion of a Child’s Personal Information.

The authorized school user may delete Student Personal Information at any time through the school dashboard or by sending a request to support@pangaeaedu.com. The authorized school user may also request that pangaea cease the further collection or use of a Child’s Personal Information or withdraw consent for pangaea to process such information by sending a request to legal@pangaeaedu.com. Such withdrawal of consent shall be treated like a deletion request.

Please note: We may not be able to immediately or completely delete all Student Personal Information in all instances, such as information retained in technical support records, customer service records, backups, and other similar business records. We will not be required to delete any information which has been de-identified or disassociated with personal identifiers such that the remaining information cannot reasonably be used to identify a particular individual.

C. Requests by Parent or Legal Guardian.

If you are a parent or legal guardian of a child using pangaea and you want to access, correct, or delete your child’s Personal Information, please contact your child’s School to submit your request and we will respond to the School’s instructions with respect to your child’s Personal Information. If you require additional assistance regarding your child’s Personal Information, please contact us at support@pangaeaedu.com. We will respond to all requests as soon as possible, but in most circumstances, we may be required to refer the request to the School or School administrator for action.

D. Retention of Student Personal Information

pangaea does not knowingly retain Student Personal Information beyond the time necessary to support the School’s educational purpose. We do not delete or de-identify any Student Data from an active School account unless directed by the School. The School administrator is responsible for maintaining current student rosters and identifying Student Personal Information which the school no longer needs for an educational purpose by submitting a deletion request. When we receive a deletion request from an authorized School user or administrator, we will comply with such deletion request within a commercially reasonable time. Unless such a deletion request is received, we retain Student Personal Information until the end of the term of our agreement with the school customer or earlier if the school notifies us that it is discontinuing its use of the Service. Thereafter, we will automatically delete or de-identify all Student Personal Information in accordance with our standard data retention policy, which generally occurs no later than one year from the end of the term or receipt of such notice.

10. WILL pangaea CHANGE THIS PRIVACY POLICY?

We may make changes to this Privacy Policy from time to time for any reason. Use of information we collect is subject to the Privacy Policy in effect at the time such information is collected. If we make material changes in the way we use Personal Information or Student Personal Information, we will endeavor to notify you via email or by posting an announcement on the Platform before the change becomes effective. Users are bound by any changes to the Privacy Policy if and when each such User continues to use the Platform after such time. Please note that it may not be possible in certain situations to provide advance notice of certain changes to the Privacy Policy or to the Terms of Service.

By accessing or using our Service, you acknowledge that you accept and consent to the practices and policies outlined in this Privacy Policy. Your use of pangaea’s Platform is at all times subject to the Terms of Service, which incorporates this Privacy Policy.
